This project involved an application to develop land located approximately 650 metres south-west of the Gisborne Town Centre. The proposed development involved the construction of 10 dwellings on a lot which had an area in excess of 4,000 square metres. Council refused the application primarily on the ground that it was inconsistent with the densities proposed in the New/Gisborne Outline Development Plan (ODP). An appeal was subsequently lodged with VCAT for a review of that decision.
The major issue addressed at the hearing was the weight which should be afforded to the ODP. Whilst the plan had been adopted by Council, and an amendment initiated to incorporate it within the Planning Scheme, a Panel Hearing had yet to be convened to assess the proposed amendment. As a result, Clause:1 successfully argued that the ODP was inconsistent with the objectives of the State and Local Planning Policies, and could therefore not be relied upon to refuse the application. The decision handed down by the Tribunal approved the application, with no alterations to the 10 dwellings proposed.
