Clause 1 was asked to get involved in this project after the applicant had prepared and lodged a planning permit application to Council seeking alterations and extensions to the existing double storey home on the subject site. Council immediately responded to inform the applicant that the proposal could not be supported due to it being in breach of the restrictive covenant registered on the land’s title. Clause 1 was able to take advantage of an under-utilised section of the Planning and Environment Act on behalf of our client and convince Council to issue planning permit as sought.
