This application proposed to custom build a new childcare facility. The site was positioned within an established residential area, which meant factors relating to the local amenity required careful consideration during the application process. Clause:1 adopted a proactive approach and, with the assistance of traffic engineering advice, gained Council’s support. Despite the application’s success, complications arose when the owner of an adjoining childcare centre appealed Council’s decision to VCAT. Arguing on the grounds that the objector was seeking a commercial advantage, Clause:1 achieved a summary dismissal of the appeal and avoided a protracted hearing.
