Project: Removal of Restrictive Covenant

This project was developed in partnership with AMA Victoria, and involved the removal of a restrictive covenant from the site which prevented more than one dwelling being constructed on the land. The removal of a restrictive covenant is a sensitive process, and covenant beneficiaries are afforded broader rights than objectors to ordinary planning permit applications. The applicants intended to use the land for a day procedure surgery, but could not seek a permit for this use until the covenant was removed. After the successful removal of the covenant, the owners were then free to begin designing a purpose built medical centre on the site.
