The site contains a purpose built warehouse, 20 car parking spaces and is located in an industrial estate. Our client’s proposal was to change the use to agricultural products manufacturing. In addition, the change of use triggered a planning permit for a reduction in the car parking requirement, as the new use had a higher parking requirement than the existing warehouse. The site was also located in an area of Aboriginal Cultural Heritage Sensitivity, although we successfully argued against the need for a Cultural Heritage Management Plan due to significant site works having already been undertaken on site.
The application process required consultation with the EPA due to the nature of the proposed activity, as well as the Victorian Department of State Development and Business Innovation (DSDBI). Clause:1 prepared a car parking assessment as part of the planning submission. As a result the application was not notified and was approved by Council in under two months.
